Chief Justice Iftikhar Chaudhry upholds Doctine of Necessity

After all the talk of the evils of “Doctrine of Necessity”, and how this “new Supreme Court” will do something new, we have the Supreme Court decision under Chief Justice Iftikhar Chaudhry endorsing the “Doctrine of Necessity”.

Using it to justify the actions that were taken by Musharraf – except that it is chastising him for doing an extra-constitutional step (when Musharraf instituted Emergency), a step that Musharraf himself acknowledged was extra-constitutional in interviews.
